I’m Samuel.
I am an Australian lawyer with substantive experience in advising and assisting charities, not-for-profit organisations, and their funders and supporters.
I have worked with:
faith-based organisations - including Protestant (parishes, congregations, churches, and organisations covering the full range of Australian Protestant denominations - but also interdenominational / parachurch organisations and ministries), Catholic (including Catholic religious orders and congregations, and agencies and ministries established by these orders and congregations), Restorationist, Muslim, and Jewish organisations;
educational institutions - including non-government schools and higher education providers;
social services organisations - including aged care providers, disability services providers, community housing organisations, and other social services organisations;
philanthropic organisations and their funders - including through public ancillary funds, private ancillary funds, and corporate giving; and
other charities and not-for-profit organisations - including sporting clubs, political advocacy organisations, cultural organisations, and environmental organisations.
In working with these organisations, I have provided charity formation, charity law, corporate governance, corporate structuring and restructuring, taxation (including income tax, Deductible Gift Recipient status, and State property taxes), philanthropy, regulatory, discrimination & human rights, and general commercial advice and assistance.
This has been (and continues to be) an absolute privilege.
I understand - and actively take into account, in providing advice and assistance - the unique, sector-specific needs of charities and not-for-profit organisations.
My experience is not limited to providing direct advice and assistance to charities, not-for-profit organisations, and their funders and supporters. I have also:
sat on committees that govern community organisations and groups;
engaged with professional associations; and
contributed to legal academia - through teaching, and through publishing (in University, Australian, and international journals and publications) my writing on various corporate law and charity law matters.
(I also have a special interest in cross-border charity law. Borne out of an English Common Law jurisdiction, Australia’s charity law has much in common with the charity law of England and Wales, New Zealand, Canada, and the United States. I am interested in the charity law of - and the regulation of charities and not-for-profit organisations in - all four of these overseas (but English Common Law) jurisdictions.)
